  1. Orders and general terms and conditions of sale

5.1 Purpose of the general terms and conditions of sale

These general terms and conditions of sale govern all orders placed by a customer via the MOLTO website or mobile application.

5.2 Order confirmation

Orders can only be confirmed if the customer has correctly identified themselves and expressly accepted these general terms and conditions of sale. Confirmation of the order constitutes a firm and definitive contract between the customer and MOLTO. Orders are processed subject to product availability. In the event of unavailability, MOLTO undertakes to inform the customer as soon as possible and may offer them an equivalent product or a refund.

5.3 Prices and payment terms

The prices displayed on the website are in euros and include all taxes, unless otherwise stated. They correspond to the prices in force at the time of the order and cannot be changed after confirmation. Payment is made exclusively online, via a secure payment platform, using a bank card or any other means of payment offered. In certain specific situations, MOLTO may accept deferred payment on the basis of an invoice, at its sole discretion.

5.4 Delivery

Deliveries are made to the address provided by the customer at the time of ordering. The customer undertakes to ensure that the delivery location is accessible. In order to provide a fast and efficient service, delivery times for the MOLTO online shop are organised as follows:

Orders placed before 10:30 a.m. (or exceptionally until 10:45 a.m.) are delivered the same day between 11:30 a.m. and 12:30 p.m.

Orders placed before 4:00 p.m. (or exceptionally until 4:15 p.m.) are delivered the same day between 5:30 p.m. and 6:30 p.m.

Orders placed after 4:00 p.m. (or after 4:15 p.m.) are delivered the next day between 11:30 a.m. and 12:30 p.m.

MOLTO makes every effort to meet these deadlines. However, the company cannot be held responsible for any delay due to force majeure, the intervention of a third party or unforeseeable circumstances beyond its control.

5.5 Receipt and complaints

Upon receipt of the products, the customer must check that they are in good condition. Any complaint relating to a delivery error or a defect found on a product must be made within a maximum of twenty-four hours after receipt. After this period, no complaints will be accepted. In accordance with applicable legislation, perishable products are not subject to the right of withdrawal once the order has been confirmed.

5.6 Promotional offers

The products offered by MOLTO may be subject to promotional offers. These offers are subject to these general terms and conditions of sale. MOLTO reserves the right to modify or withdraw a promotional offer at any time. Orders confirmed before such a modification will be honoured in accordance with the conditions in force at the time of their confirmation.

  1. Liability

MOLTO makes every effort to ensure that the information published on its website is accurate and up to date. However, this information is provided for information purposes only and does not engage the company’s liability. MOLTO cannot guarantee that its website will be error-free or accessible at all times without interruption. The user acknowledges that they use the website under their sole responsibility.

  1. Protection of personal data and privacy

MOLTO attaches particular importance to the protection of personal data. As data controller, it undertakes to comply with the legislation in force, in particular the General Data Protection Regulation (GDPR). In the course of its activities, MOLTO may collect several types of personal data, including identification data (surname, first name, address, nationality), contact details (e-mail address, telephone number, postal address), transactional data (orders, payments, invoices), browsing data (IP address, cookies, browsing habits) and data relating to interactions with the brand (participation in competitions, responses to surveys or subscriptions to newsletters). This data is collected for several purposes: order processing and delivery, customer relationship management and after-sales service, compliance with legal obligations, statistical analysis and market research, and sending commercial and promotional communications if the customer has given their consent.

The processing of this data is based on various legal grounds: the performance of a contract (e.g. order management), compliance with a legal obligation (e.g. data retention for tax or accounting purposes), the legitimate interests of MOLTO (such as improving services or website security), and the explicit consent of the customer (particularly for newsletters). The customer may withdraw this consent at any time without compromising the legality of the processing already carried out.

Personal data is only kept for as long as is strictly necessary for the purposes pursued. Thus, data related to orders is kept for the legal period provided for by regulations, while data used for commercial prospecting purposes is kept until consent is withdrawn or for a maximum of 10 years. Data may be transmitted to authorised members of the MOLTO team, technical and logistical service providers, or public authorities if required by law. MOLTO does not transfer any data outside the European Union without guarantees in accordance with the GDPR.

MOLTO implements appropriate technical and organisational measures to ensure the security and confidentiality of personal data. However, users remain responsible for the confidentiality of their login details if they have an online account.

In accordance with the GDPR, each user has specific rights over their data: the right of access, rectification, erasure, restriction, objection and portability. To exercise these rights, users may contact MOLTO by email at office@gesti.pro. Users also have the right to lodge a complaint with the Data Protection Authority (APD), Rue de la Presse 35, 1000 Brussels, https://www.autoriteprotectiondonnees.be.
